§1Acceptance of these terms

These Terms & Conditions ("Terms") are a binding agreement between you and Remissiva, a brand of The Nelson M Group LLC ("Remissiva," "we," "us"). They govern your use of remissiva.com and related services, including email and text-message programs (the "Services"). By using the Services or submitting a form, you agree to these Terms, our Privacy Policy, and, if you opt in to texts, our SMS Terms. If you do not agree, do not use the Services.

§2What Remissiva is, and is not

Remissiva is an information service. We publish general, plain-language data about how clinical research works, how to read a study listing, what informed consent means, and which questions to ask a study team, and let visitors opt in to related updates. We never give medical advice, diagnosis, or treatment, do not run, recruit for, or enroll people in clinical studies, and do not match or refer people to studies or research sites, and we do not share your details with study sponsors, research sites, recruiters, pharmaceutical or device companies, lead-generation companies, or any other partners.

• Decisions about your health and about taking part in any research are yours. Reading our content does not obligate you to do anything.
• Your doctor and the study team, not Remissiva, decide whether a study is right for you and explain its risks, procedures, and conditions.
• Every study is different. We do not guarantee that any study is safe, suitable, or open to you, or that you will qualify for or benefit from any research.

§3Eligibility

Use of the Services requires that you be at least 18 years of age, based in the United States, and legally able to contract. You may submit information solely about yourself or about someone who has authorized you to act for them.

§4Your information and accuracy

You promise that what you submit is accurate and up to date, and you will update it if anything changes. The mobile number you enter must be one you own or have authority to use. If your number changes or is reassigned, please reply STOP from the old number or contact us so that we do not message someone else.

§5Communications and text-message consent

Opting in means you agree to hear from us by email and, for the boxes you check, by automated texts as explained in the SMS Terms. Consent to texts is optional, is not a condition of purchase or of using the Services, and may be withdrawn at any time by replying STOP. Message frequency varies. Message and data rates may apply. §6Text messaging: rates, frequency, STOP and HELP

Message and data rates may apply. Message frequency may vary (up to about 8 messages a month, depending on the topics you choose). Text START to join, or opt in with the form on our Get Started or text updates page. Consent is not a condition of purchase or of using the Services.

• STOP: Reply STOP to any message to opt out (STOPALL, UNSUBSCRIBE, CANCEL, END and QUIT also work). You will get one confirmation text and then no more messages.
• HELP: Reply HELP to any message for help, or contact us by email at [email protected] or by phone at 877-550-2344.

Mobile information and opt-in data are not sold or shared with third parties or affiliates for marketing or promotional purposes. See the Privacy Policy and SMS Terms.

§7Acceptable use

Do not (a) submit information that is false, misleading, or belongs to someone else, (b) use the Services unlawfully, fraudulently, or abusively, (c) disrupt the Services or attempt unauthorized access, (d) fill in forms with bots or automated means, (e) copy, scrape, or resell our content without permission, or (f) impersonate anyone. If you do, your access may be suspended or ended.

§8Third-party organizations and links

Organizations, programs, and products mentioned on or linked from the Services (for instance government agencies, hospitals, or patient organizations) are managed by third parties, not by us. We never recommend any product, plan, or provider, and we are not answerable for their conduct, content, or results. Your relationship with any doctor or study team is between you and them.

§9Intellectual property

The Services, among them the Remissiva name, logo, text, graphics, and design, are held by us or our licensors and are protected by intellectual property laws. We give you a limited, revocable, non-exclusive, non-transferable license for personal, non-commercial viewing and use of the Services. Photos on the Site carry their own free-use licenses.

§10Disclaimers

The services and all content are offered "as is" and "as available," with no warranty of any kind, express or implied, among them any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We make no promise that the services will run without interruption or error, be secure, or that messages will arrive, or arrive on time.

Remissiva does not provide financial, legal, or tax advice, and makes no representation about any medical outcome, study result, or eligibility.

§11Limitation of liability

As far as the law allows, Remissiva and The Nelson M Group LLC, and their members, managers, officers, employees, and agents, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of (or inability to use) the services, or from any health or research decision you make or do not make. Our total liability for any claim relating to the services will not exceed one hundred U.S. dollars ($100).

Not every jurisdiction allows these limitations, and some of them may therefore not apply to you. No provision of these Terms limits liability where the law forbids limiting it.

§12Indemnification

You agree to indemnify and hold harmless The Nelson M Group LLC and its affiliates and personnel from claims, damages, and expenses (among them appropriate attorneys' fees) arising from your violation of these Terms, your misuse of the Services, or your provision of a phone number or other data that you were not authorized to supply.

§13Disputes, governing law, and arbitration

Informal resolution first. Before taking a dispute further, email us at [email protected] so that we have 30 days to try to resolve it.

Binding arbitration. Small-claims matters and claims for injunctive relief against intellectual-property misuse are excluded. Any other dispute between you and Remissiva or The Nelson M Group LLC that arises out of or relates to these Terms or the Services will be settled by final, binding, individual arbitration run by the American Arbitration Association under its Consumer Arbitration Rules. You choose whether the arbitration takes place in your county of residence or by video or phone. The arbitrator can grant the same individual relief a court could, and any court of competent jurisdiction may enter judgment on the award.

Class-action waiver. To the extent permitted by law, you and Remissiva each agree to bring claims only on an individual basis and not as a plaintiff or class member in any class, collective, or representative action.

Opt-out. You have 30 days after first accepting these Terms to opt out of arbitration, which you do by emailing [email protected] with the subject "Arbitration Opt-Out" and your name and mobile number.

Governing law. These Terms are governed by the laws of the state in which The Nelson M Group LLC has its principal place of business, without regard to conflict-of-law rules, and the Federal Arbitration Act. Subject to the arbitration clause, the state and federal courts located in that state have exclusive jurisdiction.

§14Termination

You may stop using the Services at any time, and may opt out of messages by replying STOP. At our discretion we can suspend or terminate access, including for violations of these Terms. Provisions that are meant to outlast termination (disclaimers, limitation of liability, indemnification, and disputes among them) will do so.

§15Changes

We can amend these Terms by posting a new version with a new "Last updated" date; if you keep using the Services after the effective date, you accept the amended Terms. We will give legally needed notice of material changes.

§16General

This is the entire agreement between you and us on this subject: these Terms plus the Privacy Policy and SMS Terms. The remainder survives if any part is unenforceable; failing to enforce a provision does not waive it. You need our consent to assign these Terms, while we may assign them in a merger or a sale of the business.
